  • Will of Henry Dyson of Morton Hall Inkberrow dated 1786

    In the name of God Amen, I Henry Dyson of Tiberton in the County of Worcester, Gentleman, and being now weak and infirm in body but of sound and disposing mind memory and understanding for which thanks to be rendered to Almighty God do make and declare this my last will and testament in manner and form following: that is to say First I will and direct all my just debt, legacies and funeral expenses, and the charge of proving this will, to be paid by my Executor hereinafter named.

    Item; I give and devise that my nephew, Richard Eltonhead of Gloucester, Mercer, all that messuage, or moiety of the messuage, called, or known by the name of Morton Hall, situate, and being in the parish of Inkberrow and also all buildings, court yards clases, grounds, meadows, being my freehold estate called or known by the name of Morton Hall and now with other lands belonging to me, in the occupation of William Stanton (a tenant thereof) do hold, subject to the incumbrances affecting the same, unto the said Richard Eltonhead, his heirs and assigns for ever

    Item: To Robert Hunt of Feckingham, in the said County of Worcester, Gentleman, I give and devise all that messuage, buildings and estate with the appertenances situate and being n the said parish of Inkberrow, in the said County of  Worcester, formerly part of a field called Knowle Field, in the Parish of Inkberrow aforesaid and called or known as by name of Prioress Piece, but now by the several names Barn Piece, Crabtree Piece, Further Piece and Holberrow Fields, and now in the tenance of  the said William Stanton to hold, his heirs and assigns, in trust, to receive the rents, issues, and profits thereof, and these apply, and pay to and for the use, benefit  and advantage of my nephew Richard Windle of Inkberrow aforesaid, until he shall attain to, and accomplish, his age of 21 years, then in trust, to release and convey the same messuage, lands and hereditaments, with the Appertenances, unto the said Richard Windle, his heirs and assigns for ever.

    Item: To the said Robert Hunt, I give the sum of £250 in trust to put, place and keep the same, out of interest, and the interest thereof to pay, apply, and dispose of, to and for the breeding up, educating and supporting of the said Richard Windle during his minority, and from and after he, the said Richard Windle, shall have accomplished the age of 21 years, then in trust, to pay, assign and set over the sum of £250, or the securities taken, or to be taken for the same unto the said Richard Windle his Executors, Administrators and Assigns.

    Item: To the said Robert Hunt I give a mourning ring as a token of my friendly regard for him and that of such price and value as he pleases.

    Item: To my niece, Walford, Spinster, daughter of Henry Walford late of Pershore, deceased I give £50, payable to her at the age of 21 years, without interest.

    Item: To Frances Hooper now living with me, her Executors, Administrators and Assigns, I give all my household goods and I also give to the said Frances Hooper her Executors, Administrators and Assigns the sum of £300 to be paid within the space of 12 months next after my decease, and also, I do hereby will and direct that in case my personal estate shall be insufficient to answer and pay the several legacies, by me, hereinbefore given, that then in that case the estate and hereditaments called Morton Hall hereinbefore given by me to the said Richard Eltonhead, shall be subject and liable to make good such deficiency and shall and chargeable therewith, and subject thereto, I do hereby declare that the devise of the said estate to the said Richard Eltonhead aforesaid is by me made.

    I also give to the said Robert Hunt, all the rest, residue and remainder of my money, monies at interest, bonds, bills and securities for monies, and personal estate whatsoever and wheresoever, not hereinbefore, by me disposed of. In Trust, that he the said Robert Hunt, his Executors, Administrators or Assigns, do and shall, after a discount of his and their costs charges and expenses as well for his and their care, labour, journeys, attendance's and pains, in and about the execution and management of the Trusts, hereby in sum reposed, as for monies actually paid by him to any person or persons for any business matters or things done, or to be done under my said will, and which I hereby order and direct him and them to retain and keep (divide the same equally between the said Richard Eltonhead and the said Richard Windle, share and share alike), the said Richard Windles share to be paid to him at the age of 21 years, and not before

    And I do hereby also further will and direct that the said Robert Hunt, his heirs, Executors Administrators  and Assigns, shall not be answerable or accountable for any monies which shall come to his or their hands under the Trust of this my will, and be lost by insufficient or bad securities taken for the same, or for any rents which shall be lost by insolvency of tenants, or otherwise the same not happening through his or their wilful neglect or default.

    And lastly I do hereby nominate, constitute and appoint the said Robert Hunt sole executor in trust of this  my will, and hereby revoke all former wills by me, at any time heretofore made, do declare this only to be my last will and testament. In testimony whereof, I the said Henry Dyson, the testator, have to this my last will and testament wrote on one sheet of paper, hereunto set my hand and seal, this 22nd day of November in the year of our Lord 1781.
