  • Probate Records of John Dyson of Stock and Bradley -1777

    Note;  John Dyson died intestate in 1777. He was a widower and had charge of 3 of his grandchildren, John, Sarah and Mary. He left his estate to these three who were minors, and therefore Thomas Netherton, the children's uncle in law, was appointed their legal Guardian, and was to be curator of the estate monies until the children were 21 years old, each child to inherit his or her part of the estate when they attained that age. The children's parents were apparently dead.

    The following 3 documents, and translations relate to the transactions of Probate, Guardianship and Security Affidavit;

    Probate

    I Thomas Netherton of Stock and Bradley, in the County of Worcester, Yeoman, John Barrett of the same Parish, Yeoman, and John Badger of the City of Worcester, Butcher, and John Cottrell, of Stock and Bradley are bound unto the Bishop of Worcester, in the sum of £460 to be paid by 14th April 1777.

    The Condition of this Obligation is such that the above bounden, Thomas Netherton, guardian, assigned to Sarah, Mary and John Dyson, minors, grandchildren of John Dyson, deceased, and administrator of all goods and chattels and credits of the said John Dyson, widower, intestate, do make an inventory of goods and chattels that shall come to his hands before and during the minority, and to and for the best benefit and advantage of the said Sarah, Mary and John Dyson, and to exhibit such inventory into the Registry of the Consistory Court of Worcester on or before the last day of October 1777. And an inventory of goods etc. That come into the hands of any person - to be exhibited on or before the last day of March 1778.

    Guardianship Document, after Death of John Dyson 1777, re Sarah Mary and John Dyson to Thomas Netherton

    A business of Electing and Assigning Thomas Netherton curator and guardian to Sarah, Mary and John Dyson, minors, the lawful grandchildren and next of kin of John Dyson, late of Stock and Bradley, intestate, deceased, as also Granting Letters of Administration of all goods and chattels of the deceased to Thomas Netherton - as guardian lawfully assigned to the minors until they are 21 years of age.

    On the 14th day of April 1777, before the Rev Richard Green, Doctor of Divinity, Surrogate of the Worshipful William Burrell, Doctor of Laws, Chancellor of the Diocese of Worcester lawfully appointed in the presence of the Notary Publick under written. Upon which day appeared personally, the said Sarah Dyson and Mary  Dyson and alleged that their said late Grandfather, John Dyson, deceased, died intestate, a widower, and further alleged that they are in their minority (to wit) the said Sarah of the age of 12 years and upwards and the said Mary of the age of nine years and upwards, but respectively under the age of 21 years, and thereby incapable of demanding, suing, recovering or receiving the personal estate of the said John Dyson, deceased, or giving in their own names, sufficient or proper Receipts or Discharges in Law, wherefore they made choice of the said Thomas Netherton, their Uncle in Law to be their Curator or Guardian, to all intents and purposes in law, and more especially to the effect of taking upon him  the Letters of Adtrition of  all and singular the Goods, Chattels and Credits of the said Deceased, for the proper use and benefit of the said minors during their minorities, and prayed him to be assigned accordingly, whereupon, the said Thomas Netherton, (being then present in Judgement) accepted the said Guardianship, wherefore he prayed, and the said Surrogate, at his petition, assigned him Guardian to Sarah Dyson and Mary Dyson and also to John Dyson aged 5 years and upwards, the minors aforesaid, to all intents and purposes in Law. Thomas Netherton giving sufficient security and being first sworn in common form of Law.

    An affidavit - Confirming that John Dyson's Estate, in 1777 was valued at £460

    John Dyson - Deceased - 3 May 1777

    Appeared Personally - John Barrett of Stock and Bradley in the County of Worcester, Yeoman, and John Cottrell of the same place, Yeoman, two of the securities for Thomas Netherton, administrator of all and singular the goods, chattels and credits of John Dyson, late of Stock and Bradley - aforesaid, widower, intestate, deceased, during the Minority of Sarah, Mary and John Dyson, Grandchildren, and next of kin of the said deceased, and being severally, sworn on the Holy Evangelists, to depose the truth, did depose as say as follows, (to wit) they these deponents each speaking for himself, saith that he is really and truly worth, in his own proper Estate, after all his just debts are paid the sum of $460 of good and lawful money of Great Britain

    Same day of May 1777, the said John Barrett and John Cottrell were sworn to the truth of the above affidavit.
